May 2, 2006
U
1 ~~~ i~
J~~~
Deaz Ms. Pickford,
Kate Pickford
Division of Minerals and Geology
701 Camino del Rio
Durango, Colorado 81301
a/
RE: Allen Drilling and Excavating File No. M-2005-080
Response to April 25, 2006 Ade uac- q y Review
Please accept this correspondence as formal response to the adequacy mineral rights issues
described in the fax received in my office on Apri125, 2006.
1. The applicant concurs that the documents provided indicate severed mineral rights.
Enclosed is an opinion from Mr. Joseph Middleton regazding these documents and
mineral rights.
2. If quiet title action is required, then severed mineral rights DO NOT currently
emphatically exist and the applicant should be allowed to proceed with the application.
3. The publication specifically states "If you have mineral interests, severed from these
surface rights, please contact GEGE Consulting." It is uncertain at this time if severed
mineral rights exist since no one came forward during the public notification period in
2005.
4. Mr. Allen's gravel operation does not prevent mineral right owners from developing
mineral rights. Fines will remain on site and be replaced during reclamation. Gold
reserves on the proposed site have not been explored and, therefore, not confirmed to
exist.
Further research at Pazk County assessor's and treasurer's office indicates that taxes have not
been paid on the mineral right and the count doesn't acknowledged existence of the mineral right.
Neither the treasurer's office nor the assessor's office has addresses for the parties mentioned in
the documents.
Also enclosed are copies of the well construction and test reports for three monitoring holes
constructed on the site to determine ground water level. All ground water levels are deeper than
15 feet. _ ,
Lastly, please extend the decision date from May 10, 2006 to June 14, 2006.
Respectfully submitted,
Received
Angela Bellantoni ~/ , rlFll O 1~ -"'~
Durango Fietd OY~e
Div(sion of hiinx~al~ & Geclcgy
Cr1N/iirro~nr~~rn>l~ll //,\IIL~rr~~~ii~~/~s~ Ilnc„
410 Macon Ave. Canon City, CO 81212
www.envalternatives.com • e-mail: eai(~bresnan.net
Phone: 719-275-8951 • Cell: 719-429-8950 -
/~~~~~ '~
