OTHER PERMITS AND LICENSES REQUIRED EXHIBIT M <br />The following permits are needed for the site: <br />1) County use by right -Site Plan is required for mining as well as a conditional use permit for <br />asphalt plant operations. <br />2) No COE Permit is needed since no activity will take place near waters of the United States. <br />3) An NPDES permit will be needed for the site since the pit dewatering will result in continuous <br />discharge. This permit has been obtained by FMM specifically for gravel mining on this site. <br />4} A Gravel Well permit is needed from the Division of Water Resources since water will be <br />encountered in the extraction and some will be used for consumptive use during the operation and <br />evaporation will also be considerable after the lake is created. <br />5) A fugitive emissions permit is needed for the extraction and processing since the permitted <br />production will exceed 80,000 tons per yeaz. The portable crusher/screen plant, the concrete batch <br />plant and the portable asphalt plant will have their own emissions permits. <br />6) A spill and containment plan will be made although oils and grease will not be stored on site. <br />Each plant on site will have a double walled fuel tank or a lined berm for secondary containment. <br />7) No stormwater management plan is needed since the site will contain the 100 year 24 hour <br />runoff. <br />8) State Highway Access Permit for Highway 6/50. <br />Gilsonite Pit 10/02 35 <br />
