The state of Colorado is
delegated the permitting and enforcement of permits issued under the federal Clean Water Act
The Division has not yet received m application for either process water or stormwater discharges from
the site in question. This is not unusual as most sites will get the Division of Minerals end Geology's
approval before applying for a discharge permit Unless a permit is applied for or m unauthorized
discharge occurs, the Water Quality Control Division has no authority over this site.
Most, if not all your concerns, are items which the Division of Minerals and Geology will evaluate in
approving the ruining permit for the site. Your letter has been forwarded to them. It is suggested that you
contact them with your concerns.
The Division will factor in the comments we received from you should the Compaq apply for a
discharge permit. Please contact me with a~ questions at (303) 692-3608.
Sincerely, ~ ~~ -
Patricia A.
