The state of Colorado is <br />delegated the permitting and enforcement of ptxmits issued under the federal Clean Water Act <br />The Division has not yet received eo application for either process water or stormwater discharges from <br />the site in question. This is not unusual as most sites will get the Division of Minerals aad Geology's <br />approval before applying for a discharge permit. Unless a permit is applied for or an unauthorized <br />discharge occurs, the Water Quality Control Division has no authority over this site. <br />Most, if not all your concerns, are items which the Division of Minerals and Geology will evaluate in <br />approving the mining permit for the site. Your letter has been forwarded to them.
