It has been determined that no <br />emission permit will be required for the above referenced source as the production rate will be 70,000 tons <br />per year or less. An Air Pollutant Emission Notice is required, however, as uncontrolled emissions of <br />particulate matter {TSP1 will be more than two tons per year. <br />This exemption from permit requirements is issued in reliance upon the accuracy and completeness of <br />information supplied by the applicant and is conditioned upon construction, installation, and operation in <br />accordance with this information and with representations made by the applicant or the applicant's agents. <br />Specifically, this exemption has been granted provided that the following information is accurate and <br />complete: <br />The production rate does not exceed 70,000 tons per year. Annual records of the actual production <br />rate shall be maintained and made available to the Division for inspection upon request. <br />The applicant shall follow the control plan as submitted with the application. <br />Any changes with respect to the original submittal which would result in increases in either emissions ar <br />ambient air impacts, or which would result in the emission of any pollutants not listed in the original <br />submittal, automatically rwllifies this exemption. Before actually making any such change, you must apply <br />to the Division for a now exemption based on the anticipated change; if the new exemption is denied by <br />the Division, you will have to obtain a permit BEFORE implementing the change. <br />In accordance with C.R.S. 25-7-114.1, the Air Pollutant Emission Notice (APEN) associated with this <br />source is valid for a term of five years. The five year term for this APEN expires on May 29, 2002. A <br />revised APEN shall be submitted no later than 30 days before the five year term expires. <br />This exemption is for mining related activities only.
