(IJ01;-FLOATING BOND) <br />r: <br />F11 NED LAND RELLAIMTION 60ARD <br />Department of Natural Resources <br />Room 723, 1313 Sherman Street <br />Denver, Colorado 80203 <br />Telephone: 892-3567 <br />SUPPLEMENTARY RELLAh1ATI0N BOND <br />Permit x'78 155/UG/C <br />Reclamation Bond No. CA-71066-29-86 <br />KFlOId ALL MEN 'BY THESE PRESENTS, That we (1), Western Slope La rbon, inc., of the <br />County of Gunnison, in the State of Colorado as Principal(s) and Commercial Union <br />Insurance Company of Boston, Mass. a corporation organized and existing <br />under the laws of the State of Mass. and duly authorized to transact business <br />in the State of Colorado, as Surety, are held herby and firmly bound unto the State of <br /> Colorado, acting through the Mined Land Reclamation Board in the sum of Four Thousand <br /> and no/cents (54,000.00) DOLLARS for the payment of which sum, well and truly to be made, <br /> we hereby bind ou is el ves, and each of our legal representatives, executors, administrators. <br /> successors and assigns, jointly and severally, firmly by these presents. <br /> WHEREAS, the Principal has applied for an underground coal mining and reclamation <br /> Permit from the Fti ned Land P.ec lamation Board to coduct underground coal mining operations <br />• on the following premises, to wit: <br /> a - Lay down area for construction of loading silos. <br /> b - Spillage area South of railroad tracks. <br /> c - Lay down area for construction of wash plant. <br /> d - Trackage area at East mine. <br /> These areas are all part of the operation at the Hawk's Nest F1i ne near Somerset, <br /> Colorado and were approved by the Colorado Mined Land Reclamation Board at its regular <br /> meeting in September of 1979. <br /> NOW, THEREFORE, The conditions of this obligation are such that if the above <br /> bounded principal shall, in conducting such underground coal mining operations, faithfully <br /> perform the reouirements of the reclamation plan, the provisions of the application approve <br /> by the Mined Land Reclamation Board, and the conditions of the permit issued to engage in <br /> underground coal mining operations by the Fli ned Land Reclamation Board, relating to the <br /> Colorado Mined Land Reclamation Act as amended (1976 Sess. Laws H.B. 1065) and the na es <br /> and regulations adopted pursuant thereto, upon the Mined Land Reclamation Board making a <br /> finding that the lands described above, or any portion of such lands, have been satis- <br />• factorily reclaimed and upon approving the Operator's request fora bond release on Such <br /> lands, or any portion thereof, then this obligation shall be exonerated and discharged and <br /> beco~ne null and void; otherwise to remain in full force and effect. <br />
