County of Gunnison, in the State of Colorado as Principal(s) and Commercial Union
Insurance Company of Boston, Mass. a corporation organized and existing
under the laws of the State of Mass. and duly authorized to transact business
in the State of Colorado, as Surety, are held herby and firmly bound unto the State of
Colorado, acting through the Mined Land Reclamation Board in the sum of Four Thousand
and no/cents (54,000.00) DOLLARS for the payment of which sum, well and truly to be made,
we hereby bind ou is el ves, and each of our legal representatives, executors, administrators.
successors and assigns, jointly and severally, firmly by these presents.
WHEREAS, the Principal has applied for an underground coal mining and reclamation
Permit from the Fti ned Land P.ec lamation Board to coduct underground coal mining operations
• on the following premises, to wit:
a - Lay down area for construction of loading silos.
b - Spillage area South of railroad tracks.
c - Lay down area for construction of wash plant.
d - Trackage area at East mine.
These areas are all part of the operation at the Hawk's Nest F1i ne near Somerset,
Colorado and were approved by the Colorado Mined Land Reclamation Board at its regular
meeting in September of 1979.
NOW, THEREFORE, The conditions of this obligation are such that if the above
bounded principal shall, in conducting such underground coal mining operations, faithfully
perform the reouirements of the reclamation plan, the provisions of the application approve
by the Mined Land Reclamation Board, and the conditions of the permit issued to engage in
underground coal mining operations by the Fli ned Land Reclamation Board, relating to the
Colorado Mined Land Reclamation Act as amended (1976 Sess. Laws H.B. 1065) and the na es
and regulations adopted pursuant thereto, upon the Mined Land Reclamation Board making a
finding that the lands described above, or any portion of such lands, have been satis-
• factorily reclaimed and upon approving the Operator's request fora bond release on Such
lands, or any portion thereof, then this obligation shall be exonerated and discharged and
beco~ne null and void; otherwise to remain in full force and effect.
