• ?.05.4 page 1 <br />DECLAMATION PLAIV <br />ABANDONMENT OF THE MINE: <br />REMOVAL OF SURFACE FACILITIES <br />All mine portal facilities, shown on Map C-4, will be tom down, the foundations removed <br />where they won't be covered by at least 4 feet of fill and topsoil, and all debris taken from the area to <br />the La Plata County landfil] for disposal. All useable buildings which lie on Lawrence Huntington's <br />property, including the shop and upper pumphouse, along with the access road will be left intact at the <br />request of Mr. Huntington. Mr. Huntington has made such a request by letter to both the Colorado <br />M.L.R.D. and National King Coal, LLC (See Appendix 9(1)). The steep cut slope azea behind the shop <br />building will remain as is to allow continued use of the shop by the surface landowner. This highwall <br />was constructed during the summer of 1976. Don May, P.E., has certified [he stability of this area <br />(See Appendix 7). Salvageable items (conveyors, motors, mining supplies and equipment) will be sold <br />and removed from the property. The remainder of the surface buildings including the bathhouse, <br />scalehouse, substation, old scale & storage building adjacent to Bumwell #2 Tipple, etc., will be left <br />intact and will be used to accommodate the stated post mining land use. <br />The access road [o the site will not be reclaimed but maintained for access to the reclaimed <br />mine bench for reclamation work and inspection of the site. The access road will also be used by the <br />owners of the site for transporting livestock to and from the area. The surface land owner has so <br />requested by letter noted above. <br />Upon conclusion of mining, the water wells will be transferred to the landowners. The water <br />well shown on Map C-4, located in the meadow of Hay Gulch off the permit azea is the property of Mr. <br />• Wiltze. National King Coal, LLC has water rights at this well until September 1, 1998, with renewal <br />options there-after (See Appendix 2(7)). <br />The water impoundments (sediment ponds) are not intended as permanent constructions on the <br />mine site, but will remain intact until the site has been successfully reclaimed. <br />The diversion channels and buried culvert pipe will be maintained during the reclamation <br />program until the area is stabilized and soil erosion and plant damage is unlikely to occur during spring <br />runoffs. Seedlings and young plants could be washed out and the graded top soils eroded with deep <br />gullies during heavy runoff periods until enough vegetation on the pennit area can hold the soil in <br />place, the open channels must be inspected periodically for erosion. After vegetation is reestablished <br />the open channels will be filled and graded and seeded. <br /> <br />January 1998 <br />
