Walther
Erecwive Duector
Michael B. Lang
Dlvlsion Director
r
The Division completed a technical review of the referenced permit application. In order to meet
the minimum requirements of the Actl Rules and Regulations the following items must be
addressed:
1. The permit application form stipulates only 9.12 acres aze to be permitted. However, the
exhibits show an affected area consisting of a 9.12 acre pit and a 0.49 acre access road. This
equals 9.61 acres. Page one of the application form must be revised to reflect the correct amount
of affected lands. You aze correct to include the access road in the permit area since the operator
intends to uoerade and maintain the existing road, pursuant to Rule 6.3.3(g), even [hough the
road will remain unreclaimed at the end of mining operations.
~ , 2. You stipulate in Exhibit B that there are no man-made structures within 200 feet of the
permit area. This implies the proposed permit area lies in an open range area; no fences. If true,
the permit area may need to be fenced after mining ceases in order to prevent grazing.
3. The submittal stipulates that the access road is existing but will be upgraded and
maintained. Please describe in detail how the road will be upgraded and maintained.
4. If groundwater is encountered the operator will need to comply with Colorado water laws
~i~ or backfill the areas which have encountered water. The operator needs to commit to completing
one of these remediation requirements.
5. The operator proposes to leave 2:1 sideslopes. Pursuant to Rule 6.3.4(I)(b), if the applicant
~ proposes slopes steeper than 3:1 the applicant must include ajustification that supports steeper
~ slopes for the proposed post-mining land use, and demonstrates compliance with the applicable
performance standards of Section 3.1.
