<br />SPECIAL STIPULATIONS <br />• 1. Prior to initiating mining in any area of lease C-27432, Colorado <br />Westmoreland shall provide, as an integral part of the mining and <br />reclamation plan, a demonstration that surface coal mining and reclamation <br />operations at the Orchard Valley Mine can be feasibly accomplished to <br />comply with 30 CFR Sections 817.121, 817.124, and 817.126. The <br />demonstration shall include, at a minimum, measurements prior to and <br />during mining that show any measureable subsidence caused by previous <br />mining or which document no subsidence to date. All measurements shall be <br />related to potential effects on "renewable resource lands" (Section 701.5 <br />of Title 30 ). The demonstration shall also address the type and frequency <br />of future measurements that will be used to monitor for subsidence. Prior <br />to initiating mining in any area of lease C-27432, Colorado Westmoreland <br />shall obtain the approval of the regulatory authority of the demonstration <br />and the subsidence monitoring program. The demonstration shall also <br />include a map showing fractures and joints of significance encountered <br />during previous mining, a plan to periodically update the map as mining <br />progresses, and a program to report rib and roof conditions in areas that <br />will cave and subside. <br />2. By no later than June 30, 1980, Colorado Westmoreland shall submit, to the <br />regulatory authority, an acceptable report on an intensive cultural <br />resource inventory (Class III inventory, BLM Slll Manual) covering, at a <br />minimum, all portions of the NW1/4 of Sections 18 and the SW1/4 of Sec. 7, <br />R. 91 W., T. 13 S. The report shall be of a professionally acceptable <br />quality meeting the Bureau of Land Management's 8111 Manual and any <br />guidelines developed by OSM. Should sites be found which are eligible for <br />or included in the National Register of Historic Places, include a <br />detailed avoidance/mitigation plan for those sites which have the <br />potential for receiving any direct or indirect impacts (through subsidence <br />or vandalism). <br />• <br />
