S. <br />Sec. 31. Special Stipulations (continued) <br />(1) The lessee shall consult with all owners of occupied dwellings and maintain <br />or, with the owner's consent, adjust the designated 300-foot buffer zone in <br />order to mine near private dwellings located on the lease. <br />(m) With respect to the golden eagle nest sites, identified on this lease (maps <br />attached) or any eagle nest sites discovered in the future: <br />(1) No permanent surface facilities or disturbances shall be Located <br />within a one-fourth mile radius buffer zone around each golden eagle <br />nest site. <br />(2) No surface activities will be allowed within the eagle nest site buffer <br />zones from March 1 to July L. <br />(3) Any proposed activities in, or adjacent to the eagle nest site buffer <br />zones will require approval from the BL?1 on a site-specific basis, <br />after consultation vLth the U.S. Fish and Wildlife Service. <br />(n) A 1/8 mile buffer zone on each side of perennial, intermittent, and ephemeral <br />streams with riparian habitat will be protected from suface disturbance, <br />excluding subsidence. If riparian habitat disturbance is unavoidable, i[ will <br />be appr wed on a site specific basis by BL~i after consultation with the Colorado <br />Division of Wildlife and the U.S. Fieh and Wildlife Service. <br />(o) A seasonal closure on surface activities, from December 1 to Arpil 15, shall <br />be imposed on all portions of the lease identified as "most critical big game <br />• winter range" (map attached). Where surface facilites must be located on <br />these ranges, off-site habitat improvement or mitigation may be required. Such <br />activities must be appr wed by the.BLM after consultation with the Colorado <br />Division of Wildlife. <br />(p) The lessee, prior to mining coal,, will prepare a NEPA quality environmental <br />analysis assessing alternative methods of transportation. The purpose of the <br />assessment is to determine the most environmentally acceptable and least <br />impactin; routs and/or means of hauling coal to the loadou[ facility. The <br />asses:;mont will consider all impacted resources. <br />The aL:~: r:i.itivas assessed wLll be determined by BI.M (Montrose District) in <br />conaultatt~~n with the lessee, Delta County and the State of Colorado (Mined Iand <br />Reclamation Division and State Department of Transportation). The BLN, with <br />tlir :~buve consulting agencies will determine if the analysis meets NEPA require- <br />ments upon its completion. The most environmentally and economically acceptable <br />and least impacting route and/or means of hauling coal to the to ad out facility <br />will be submitted by the lessee as part of the Colorado Mined Iand Reclamation <br />Division permit application. The assessment will be accompanied by a separate <br />analysis of the economic feasability of each alternative assessed to be utilized <br />in the decision making process. <br />(q) The mine permitting process will include, but not be limited to, the <br />consideration of the following operational mitigating measures: <br />• (L) Detailed geotechnical studies shall be conducted by the lessuu prior to <br />construction of a portal and associated facilities to determine if the <br />area is compatible vith the new portal site. <br />(2) A visual contrast analysis will be made by the lessee prior to.construc- <br />tion of proposed surface modifications and reclamation efforts to assure <br />minimum visual impact at all stages of tract development, and compliance <br />with BLM`s Visual Resource Management (VRM)-polieies. <br />(3) All coal transportation will be by conveyor or other permanent <br />alternative method to avoid truck hauling on State Highway 133. <br />l l: UlV 8l bdY ~Q <br />.~,!, av~ .~i,~ <br />,~... ~nr <br />
