Smith d.b.a. Censer Redi Mix located in <br />the W1/2 SWt/4 Section 35, Township 41 North, Range 7 East N.M.P.M., and <br />WHEREAS, Kenny D. and Dana K. Smith d.b.a. Center Redi Mix are the owners of the property located <br />within the W1/2 SWt/4 Section 35, Township 41 North, Range 7 East N.M.P.M., and <br />WHEREAS, the owners intend to use this property for a use other than agricultural and, <br />WHERAS, the Saguache County Land Development Code requires within Article IV approval be given for <br />Conditional Use by the Board of County Commissioners, and <br />WHEREAS, the Saguache County Planning Commission has examined the Conditional Use request from <br />the owners and having found no reason to deny such request, voted to recommend approval in their regular <br />meeting on June 25,1998. <br />FURTHER, any such Conditional Use shall be for the purpose of conducting a sand and gravel pit area, and <br />a conaete and asphalt processing area, <br />FURTHER, any other Conditional Use other than that granted shall require a separate application and all <br />other maUers as required in Article IV Section 3.1 through 3.3.6 of the Saguache County Development Code <br />• adopted April 1, 1998, <br />FURTHER, the Board of County Commissioners in granting this Conditional Use have considered assurance <br />from the applicants, Kenny D. and Dana K. Smith d.b.a. Center Redi Mix with comments being heard from <br />the public at a Public Hearing held on June 30,1998. <br />THEREFORE BE IT RESOLVED that the Saguache County Board of Commissioners grant Kenny D. and <br />Dana K. Smith d.b.a. Center Redi Mix a Conditional Use Permit on the W1/2 SW 1/4 Section 35, Township 41 <br />North, Range 7 East N.M.P.M. <br />THAT, Center Redi Mix agrees to follow the conUact signed by Kenny D. and Dana K.
