3 ' ¢ ~,Jo ~b~t~,(~q ~v5 <br />BEFORE THE MINED LAND RECLAMATION BOARD i <br />STATE OF COLORADO <br />----------------------------------------------~c~ _rsJ~ a~f,~~-tam, <br />PREHEARING ORDER C~l~ `E'g/~5`~ I _~l <br />IN THE MATTER OF SUMMIT BRICK AND TILE CO.'S CALHAN CLAY PIT, <br />PERMIT NO. M-93-080, APPROVAL OF APPLICATION <br />This Prehearing Order is proposed to the Mined Land <br />Reclamation Board ("Board") by the prehearing conference officer to <br />govern the hearing in this matter. This order, as amended by the <br />Board, shall be effective upon approval by the Board. <br />I. PARTIES <br />1. The following have been admitted as parties to the <br />proceedings: <br />a. Summit Brick and Tile Co., <br />b. Terry Galbreath, <br />c. Bennie and Thelma Kobilan. <br />2. The Division of Minerals and Geology ("Division") shall <br />not be a party, but shall participate in the hearing as staff to <br />the Board. <br />Persons formerly objecting were not present at the prehearing <br />conference, although they were duly notified. <br />II. ISSUES TO BE CONSIDERED <br />Presentations to the Board shall be strictly limited to the <br />issue of whether the pending application complies with the <br />requirements of the Colorado Mined Land Reclamation Act and the <br />regulations promulgated by the Board. The parties shall limit <br />presentations to the question of whether the pending application <br />should be approved or denied, based on the issues stated below: <br />1. Whether the applicant has demonstrated to the Division's <br />satisfaction that there will not be an adverse impact to local <br />groundwater supplies, including both quality and quantity; <br />2. Whether the applicant has demonstrated to the Division's <br />satisfaction that there will not be an adverse impact to surface <br />
