File numbers 83-214 through 83-219. <br />Dear Mr. McArdle: <br />Based on my review o1= a letter to you from Burke Lokey, Mesa County Depart- <br />ment of Engineering dated April 13, 1984, it is my understanding that the <br />Mined Land Reclamation Division now has in its possession all requested infor- <br />mation regarding the Mesa County Gravel Pits (File number 83-214 through <br />83 -219), except the information regarding zoning. <br />With regard to zoninl;, each of the gravel pits in question is located in an <br />area zoned Agricultural, Forestry, and Transitional (AFT Pursuant to the <br />County zoning resolution and land use code, gravel mining is a permitted <br />activity which is allowed in AFT zones pursuant to conditional use permits. <br />Gravel mining is not., hocaever, considered to be a use by right in an AFT <br />zone. As a result, :since the underlying zoning is appropriate for the pro- <br />posed use, no zone change is required. <br />The only requirement is that a conditional use permit be obtained so that the <br />use may be regulated., This is considered to be a considerably less difficult <br />process than a zone change. As you are aware, the County is undergoin¢ the <br />review process for a conditional use permit for each Pit. The review of the <br />permits for each Pit will be accomplished before the Piesa County Planning <br />Commission on April :L9, 1984 and before the Board of County Commissioners on <br />May 15, 1984. It is my understanding that the Planning Commission has placed <br />a review on its consent agenda since no significant comments or problems are <br />present. <br />This letter is forma.L notification to the Mined Land Reclamation Division <br />that the underlying :zoning of AFT for each of the six gravel Pits in question <br />is sufficient to allow gravel mining in each Pit.
