<br />Western Fuels-Colorado, LLC <br />New Horizon Mine <br />P.O. Box 628 <br />Nucla, CO 81924 <br />April 5, 1999 <br />Dear Owner/Resident: <br />Western Fuels-Colorado, LLC conducts surface coal mining operations at <br />the New Horizon Mine located just west of Nucla, Colorado. We are <br />required by Colorado and Federal law to publish our blasting schedule in <br />the local newspaper every twelve months. We are also required to mail <br />or deliver a copy of the blasting schedule to each residence located <br />within one-half mile of the blasting site described in the schedule. <br />Enclosed is a copy of the 1999-2000 blasting schedule. <br />If you have not had a pre-blasting survey conducted on your residence, <br />and the residence is located within one-half mile of the blasting site, <br />you have the right to request one. If you have added to or remodelled <br />the residence since your previous pre-blasting survey, you may request <br />another. The survey will determine the condition of the dwelling and <br />document any existing damage and other physical factors that could <br />reasonably be expected to be affected by blasting. Assessments of <br />. structures such as cables, pipes, transmission lines, wells and other <br />water systems, and septic systems shall be limited to surface conditions <br />and readily available data. Special attention will be given to the <br />conditions o£ wells and cisterns used for human, animal, or agricultural <br />purposes and to the quality and quantity of well water. <br />If you believe a residence owned or occupied by you falls within the <br />one-half mile radius, it has not previously been surveyed, and you want <br />a survey conducted on it; please call Ross Gub ka at (970) 865-7910 or <br />John King at (970) 869-7590. If they do not answer, you may leave a <br />message on their voice mail; but please give your name, telephone <br />number, the physical address of the residence to be surveyed, and the <br />best time to return your call. You should also feel free to stop by the <br />mine office at 27696 West 5th in Nucla to make your request if you <br />prefer. <br />We have conducted over 150 surveys of residences in the Nucla area, so <br />it is likely that yours has already been surveyed.
