to the pond excavation. During passage of the 10-year, 24-hour storm the spillway does <br />not discharge sediment downstream nor is there any flow through the emergency spillway. <br />The pond will be a temporary structure, and therefore has been designed to safely pass the <br />flow from the 25-year, 24-hour precipitation event. The final ponding capacity will be <br />constructed to contain approximately four years of sediment storage. Ih addition, the <br />spillway is designed and constructed to safely discharge the 25-year, 24-hour storm event. <br />The embankment will be constructed to be stable and provide adequate freeboard. <br />Therefore, based on the design, this structure complies with the appropriate regulations <br />for a temporary sediment structure. Peabody Coat Company wilt periodically inspect the <br />structure for sediment storage, structural integrity, and hazardous conditions. <br />Maintenance and remedial work will be performed in accordance with the approved mine <br />permit. <br />Construction Plan. The construction of Sediment Pond 009 will be performed in such a <br />manner to adhere to standard and sound engineering and construction practices. Topsoil Removal and Placement in Designated Areas - All recoverable topsoil <br />containing organic or other deleterious material will be removed and placed in <br />designated areas. Estimated depths of topsoil that will be removed are shown on <br />Exhibit 9-1 "Soil Types and Topsoil Salvage Map" in the Seneca II-W Permit <br />Application. All topsoil removal and placement operations will 6e performed in <br />actor da nee with Colorado Rules and Regulations. <br />3. Earthwork All work covered by this section consists of hauling, wetting or dr yinq, <br />rolling, and other operations for constructing and preparing the earthwork in <br />accordance with standard sound engineering and construction practices. <br />A. Excavation. Excavation will consist of the removal and satisfactory placement <br />of all materials to lines, grades, and cross section for the construction of <br />Sediment Pond 009. Grading will be done to conform with the typical sections. <br />1. Slopes. Slopes of all excavations will be cut true and straight and all <br />loose stones, boulders, roots, and stumps in the slopes will be removed. <br /> ~• <br />13-5-10 <br />
