Based on the results this study, Rockcastle <br />will implement additional reclamation measures to stabilize geotechnically or <br />• geomorphically unstable areas of Pits 5 and 6. If additional reclamation <br />activities are required as a result of the engineering study of Pits 5 and 6, <br />and remain uncompleted at the time of final bond release pursuant to 3 V, the <br />cost of these uncompleted activities and associated liability will be taken into <br />consideration by the Division before the final bond release increment is returned <br />to Rockcastle pursuant to 3 V. <br />,/2. Rockcastle will reassess the geotechnical stability of the potential <br />slope failure area adjacent to the haul road to Pit 4. Based on this assessment <br />Rockcastle shall implement appropriate reclamation measures to the extent <br />necessary to stabilize mass movement features related to the haul road to Pit <br />4 only in those areas that are not stable pursuant to 2 CCR 407-2 Rule 4.14.2. <br />Rockcastle and the Division agree that slope stabilization work contemplated <br />under this section may require importation of material from offsite sources only <br />if suitable material is unavailable at the Site. <br />V 3. To the extent possible and consistent with the postmining land use, <br />Rockcastle will remove culverts and other drainage and sediment controls upon <br />completion of the revegetation demonstration described in 3 III(2)(a). <br />Rockcastle may retain sediment control structures as necessary to support any <br />permanent impoundments which may be retained pursuant to 3 III(2)(b). ~ <br />-6- <br />r <br />
