activities under this~lgreement shall use Seed Mix ~ - Primary Reclamation, <br />described on page IV-12 of the Permit. <br />• V 4. Remove the shop building adjacent to Pit 4 and retopsoil and reseed <br />the shop and yard areas. Rockcastle will recontour the shop and yard area fill <br />pad as necessary to achieve approximate original contour criteria of 2 CCR 407- <br />2, Rule 4.14.2 and 1.04(13). <br />5. Rockcastle shall retain sole discretion over the sequencing of <br />reclamation activities conducted pursuant to this Agreement. <br />/ 6. The reclamation activities specified herein will commence as soon <br />as possible. The reclamation activities specified herein will be completed by <br />November 30, 1990. The date of completion of reclamation shall be extended by <br />mutual agreement of the Division and Rockcastle if the reclamation activities <br />are delayed due to weather conditions or other circumstances beyond the <br />reasonable control of Rockcastle. <br />III. ROADS AND SEDIMENT PONDS -- The Division and Rockcastle agree: <br />b~` 1. That the Reclamation Plan contemplates retention of roads and that <br />C^" the surface landowner has requested that these roads remain after site <br />reclamation. Haul roads shall be retained as directed by the surface landowner.# <br />If the surface landowner fails to provide direction regarding retention of the <br />roads, the roads will be sized and designed to reduce maintenance and to <br />facilitate the approved postmining land use.
