on all parties, and shall not be appealable. During arbitration, each party shall continue to <br />perform its obligations under this Lease. <br />23. Confidentiality and Public Statements <br />a. Except as otherwise provided in this section, the temms and conditions of this <br />Lease, all data, reports, records and other informa[ion of any kind whatsoever <br />developed or acquired by any party in connection with this Lease shall be treated <br />by the parties as confidential ("confidential information") during Ume tenu of this <br />Lease. <br />The foregoing restrictions shall not prevent the disclosure of confidential <br />information to attorneys, accountants and other professional and clerical <br />personnel retained by the parties, affiliates, financial institutions, or proposed <br />transferees, if such persons agree to Ue bound by this Section, nor prevent the <br />disclosure of confidential information that otherwise comes into the public <br />domain or is required by law. Except as otherwise provided above, neither party <br />shall make any public announcement or disclosure with regard to this Lease or <br />any operations hereunder, without the prior written consent of the other party, <br />which consent shall not be utueasonably withheld. Nothing in this Section shall <br />give Lorencito any right to use or disclose to any party any non-public <br />information regarding the Hills' activities on the Leased Lands. <br />24. Organization, Qualification, and Authority <br />a. Lorencito represents that it is a limited liability compazmy duly organized, validly <br />existing and in good standing under the laws of Colorado. <br />b. F.R. Hill, Jr., d/b/a F.E: Hill Company, represents that F.R. Hill, Jr., is a partner of <br />F.E. Hill Company, a Texas partnership, the Assumed Name Certificate of which <br />is filed in the records of Freestone County, Texas in Volume 2, Page 38 of the <br />Assumed Name Records. <br />c. Hill Ranch represents that B.F. Hi(1 is the managing partner of Hill Ranch, a <br />Texas partnership. <br />d.
