Dear Mr. Anderson:
- We are responding to a request by Mr. Jerry M. Nettleton of
TerraMatrix/Montgomery Watson on your behalf for a Department of
the Army permit for approximately 1,450 feet of headwaters
impact. The project is located within Section e, Township 13
South, Range •90 West, Gunnison County, Colorado.
The Chief of Engineers has issued nationwide general permit
number 26 which authorizes the discharge of dredged or fill
material in waters of the United States for headwaters and
isolated waters discharges. Your project can be constructed
• under this authority provided the work meets the conditions
listed on the enclosed information sheets and the following
special conditions:
1. The permittee shall perform reclamation procedures as
outlined in your application by TerraMatrix/Montgomery Watson
following the life of the project.
2. To compensate for the loss of 1,450 feet of headwaters
channel a final mitigation plan to offset these impacts at a 1:1
ratio will be required. The Mitigation plan must be approved and
implemented concurrent with project construction in
jurisdictional waters of the United States.
The Corps of Engineers has made a determination of "no
affect" on threatened or endangered species for this project.
This permit verification will be valid until December 13, 1998.
You should contact this office if work will extend beyond this
date. You must also notify this office in writing within 30 days
after project completion that the work was performed in
accordance with this authorization.
