Per Rule 6.4.19 please provide, as appropriate, one of the following for each of the man made <br />structures. (The two irrigation structures that the landowner wished removed do not require an <br />agreement if the letter from the landowner is submitted stating that the structures aze to be <br />removed). <br />(a) Provide a notarized agreement between the applicant and the person(s) having an <br />interest in the structure, that the applicant is to provide compensation for any damage to <br />the structure; or <br />(b) Where such an agreement cannot be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by <br />activities occurring at the mining operation. <br />(c) Where such structure is a utility, the Applicant may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that the mining and reclamation activities, as <br />proposed, will have "no negative effect" on their utility. <br />6.5 GEOTECHNICAL STABILITY EXHIBIT <br />This section maybe adequate as submitted. This adequacy determination depends on submission <br />of additional information on the mining operations requested above, especially as regards permanent man- <br />made structures. <br />Given the extensive nature of the adequacy responses that the applicant will need to provide to the <br />Division, the Division will request the Applicant to provide a complete revised application once all the <br />adequacy issues have been addressed. <br />I look forward to your response. Please allow adequate time for review before the December I5, 2006 the <br />decision date. Rule 1.8.1 states that changes and additions to the pemut application must be filed with the <br />Division and the County Clerk and Recorder. The applicant must also provide the Division with an <br />affidavit or receipt demonstrating that the change or addition was filed with the County Clerk and Recorder <br />no later than the close of business on the day the change was filed with the Division.
