January 2, 1970
Mr. Charles Berry, Esq.
Attorney's Office
El Paso County, Colorado
Dear Mr. Berryf
We have recently received 30 applications for mining and reclamation permits,
for the gravel pits operated by E1 Paso County. The applications are
apparently the county's attempts at compliance with 34-32-101 C.R.S. 1973
as amended (the Colorado Mined Land Reclamation Act) . Unfortunately, the
applications are still incomplete, and inadequate. The E1 Paso Applications
were reviewed by several board members at the December 21 board meeting,
and the board has specifically requested that you be advised of the
inadgquate nature of the applications.
The particular deficiencies of the recently submitted applications are
itemized below.
(1) No application fees were submitted. On each application it is
noted that the application fee is "unknown due to weather con-
i ditions."
(2) The exhibits were not submitted, or those that were are not
proper. For example, the description in your purchase orders
will not suffice as a legal description of the property.
(3) No acreage figures were submitted for each gravel pit. All
the applications note that the affected acreage "would depend
on acts of God." The general practice is to simply estimate
the total acreage to be affected by the operation.
(4) The proposed future land use has not been identified for any of
the gravel pits. Each application notes that "the landowner has
not informed El Paso County." The county should simply work out
an acceptable land use for the reclaimed land with the landowner.
In most cases, the future use is simply grazing land or dry land
farming. The purpose of this requirement should be obvious —
the reclamation plan should be designed with the future land use
In mind.
(3) Only a general map mas submitted with the applications. A more
detailed map should be submitted for each application.
(6) The requisite information about wildlife was not submitted. The
Colorado Division of Wildlife will assist in providing this in-
formation, but it is incumbent upon the applicatioso obtain the
