In terms of Federal lands, the re-assessment demonstrated there are no identified spring, seep or pond <br />features under which planned coal mining activities will take place, that would be classified as "high <br />value" hydrologic resources. <br />With respect to the three "high value" resowces located on private lands, OMLLC has commitments <br />within the CDMG Permit C-1981-022 (permit page 2,05-88) to work with "area land owners to restore, <br />replace or provide reasonable compensation for any significant livestock watering sources that are <br />adversely impacted". Given the thickness of overbwden cover in the vicinity of these resources (in <br />excess of 2300') coal mining activities are predicted to cause no "injury" to these hydrologic resources. <br />With respect to Bear creek, please see the discussion in a later section. <br />2. SITES NEVER FOUND OR LOCATED. <br />A number of hydrologic sites previously identified in the Elk Creek lease could not be Found and <br />assumed to never exist. The reference to the following sites on the revised CDMG permit Map 2.04-M2 <br />Regional Geology/Hydrology have been deleted. <br />ECP-1 <br />ECP-8 <br />ECSP-10 <br />ECP-11 <br />ECSP-12 <br />ECR16 <br />ECSP-18 <br />ECSP-19 <br />ECSP-21 <br />ECP-24 <br />ECSP-28 <br />3. SITES LOCATED WITHIN THE LEASE AND CDMG PERMIT AREA BUT LOCATED <br />OUTSIDE OF THE PLANNED MINING AREA. <br />These sites are located within the CDMG permit area and within the Federal coal lease but are not <br />located above planned coal mining activities. These sites are shown on Map 2.04-M2 Regional <br />Geology/Hydrology. <br />ECP-26 <br />ECSP-30 <br />ECP-31 <br />Pond ECP-26 appears to be a man-made runoff only pond. The source of water comes from an up <br />gradient slide/erosional feature located in fine textured clay soils that readily sheds water during <br />significant runoff events. <br />ECSP 30 is a "high value" man-made pond fed by the perennial and reliable "Desty's" spring ]ocated <br />nearby. Because of the perennial flow from the spring, this pond contains water into the fall months. <br />ECP-31 is a man-made runoff pond designed to captwe spring runoff. This pond was dry by fall. <br />4. SITES LOCATED OUTSIDE OF EITHER THE LEASE AREA OR CDMG PERMIT AREA. <br />A number of sites are located outside of the limits of the Federal coal lease or outside of the CDMG <br />permit area. A number of sites (beginning with site ECSP-29) were new sites added to the inventory. <br />These sites do not lie above planned coal mining activities.
