<br />RESOLUTION
<br />
<br />RE: APPROVE AGREEMENT FOR COMPENSATION OF DAMAGES TO WELD COUNTY
<br />ROADS 15 AND 26.75 - OWENS BROTHERS CONCRETE COMPANY (USR #1102)
<br />WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
<br />Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
<br />administering the affairs of Weld County, Colorado, and
<br />WHEREAS, by Resolution dated March 6, 1996, the Board conditionally approved a
<br />Site Specific Development Plan and Special Review Permit for a wet sand and gravel mining
<br />operation in the A (Agricultural) Zone District, USR #1102, for Owens Brothers Concrete
<br />Company, 5550 Sheridan Boulevard, Arvada, Colorado 80002, on the following described real
<br />estate, to-wit:
<br />Part of the W1/2 of Section 32, Township 3 North,
<br />Range 67 West of the 6th P.M., Weld County, Colorado
<br />WHEREAS, pursuant to the applicant's application to the Colorado Division of Minerals
<br />and Geology, Rule 6.4.19 of the Colorado Mined Land Reclamation Board requires a notarized
<br />agreement between the applicant and the owners of any permanent man-made structure within
<br />200 feet of the affected land, whereby the applicant agrees to compensate the owner for any
<br />damage caused by the mining, and
<br />WHEREAS, said operation lies within 200 feet of Weld County Roads 15 and 26.75, and
<br />WHEREAS, the Board has been presented with such an Agreement for Compensation
<br />of Damages to Weld County Roads 15 and 26.75 between the County of Weld, State of
<br />Colorado, by and through the Board of County Commissioners of Weld County, and Owens
<br />Brothers Concrete Company, with terms and conditions being as stated in said agreement, and
<br />WHEREAS, after review, the Board deems it advisable to approve said agreement, a
<br />copy of which is attached hereto and incorporated herein by reference.
<br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
<br />Weld County, Colorado, that the Agreement for Compensation of Damages to Weld County
<br />Roads 15 and 26.75 between the County of Weld, State of Colorado, by and through the Board
<br />of County Commissioners of Weld County, and Owens Brothers Concrete Company be, and
<br />hereby is, approved.
