BoX 667 ~~N 01 1993 <br />Craig, Colorado 81626 <br />Re: Cross Mountain Pit No. 1 - M-93-023 ~'VISIOno1Miner31sdGN~,. <br />Dear Mr. Moore: <br />Thank you for your correspondence of May 25, 1993 concerning the Cross <br />Mountain Pit No. 1. <br />The location of this pit, on a bench above a major river, is in an area <br />that is highly likely to contain cultural resources. This is why a <br />recommendation for a cultural resource survey was made in our March 23, <br />1993 correspondence to Carl B. Mount with the Division of Minerals and <br />Geology. <br />Issuance of a permit by a state agency is clearly defined as an "action" of <br />that agency (CRS 24-80.1-102(1)). We refer you to the Register of Historic <br />Places Act, 24-80.1-104 regarding a state agency's role concerning an <br />action that might have an effect on an historic property. As written, it <br />is the agency's responsibility to "...identify such properties located <br />within the area of the proposed action...." Part of the process of <br />identification may involve a cultural resource survey. <br />Section 24-80.1-107, the section you cite concerning the written approval <br />of the owner of the land and the property, refers to the formal process of <br />nominating a property to the State Register of Historic Places. <br />We are enclosing a copy of the law and its implemen[ing regulations.
