Lessor warrants title to the Frazier Property and to al] sand, gravel, and related <br />' products located on the Frazier Property, and fitrther warrants and covenants that Delta Paving shall <br />have the right to extract sand, eravel, and related products from the Frazier Property and otherwise <br />' use and occupy the Frazier Property as set forth in this lease without interference from any person. <br />' This warranty does not apply to any permit conditions or other governmental conditions or approvals <br />that Delta Paving must have or meet to conduct its operations on the Frazier Property tinder this <br />lease, compliance with which are Delta Paving's sole obligation and responsibility. <br />9. Lessor shall pay all real property taxes and special assessments relating to the Frazier <br />Property and not created by Delta Paving's mining activities. during the temp of this lease. Delta <br />' Paving shall pay all personal property [axes and any and all inventory taxes which may be imposed <br />' or incurred during the term of this lease, and all costs and expenses relating to compliance with any <br />' permit conditions or other govenunental conditions or approvals that Delta Paving must have or <br />meet to conduct its operations on the Frazier Property under this lease. <br />' I0. Delta Paving shall pay all charges for electricity, gas, water and utilities famished or <br />' supplied to it in connection with its operations. <br />11. Delta Paving may, at its sole cost and expense, subject to all governmental laws, <br />' authorizations and regulations, make such repairs and improvements to the Frazier Property as it may <br />desire at its option. All improvements shall be removed from the Frazier Property by Delta Paving <br />after the expiration or other termination of this lease, as provided in Paragraph 14, below. <br />' 12. Delta Paving agrees that at all times during the term of this lease, it shall keep <br />Workmen's Compensation Insurance in full force and effect.
