Long <br />Division Director <br />THIS PERMIT is issued by the Mined Land Reclamation Board, Department of Natural Resources, <br />State of Colorado. <br />RECITALS <br />A. The Permittee, Lmcoln Couth ,desires to crsrdud a mining operation lmown as O'Dwyer, for <br />the purpose of e~racting sand and gravel. The Pemrittee will not mine any secardary commodities at this site. <br />B. On March 25, 2002 the Mined Land Reclamation Boazd (the "Board") approved the Pemrittee's <br />application for this pemtit and directed that this peanit be issued upon the filing with the Division of Minerals and <br />Geology (the "Division") of performance warranty approved by the Division. Said warranty has been filed with <br />the Division. <br />C. If the Pemuttee desires to extrad materials other than those listed in (A), a separate pemut may <br />be required. <br />D. On March 25, 2002 the Board made the following findings: <br />I. The application for this pemrit complies with the requirem~rts of the Colorado Mined <br />Land Reclamation Ad for the Erdradion of Construction Materials, C.R.S. 34-32.5-101 et sue., as amended, and <br />with all applicable local, state and federal laws; <br />2. the operation will not adversely affect the stability of any significant, valuable, and <br />pemlarterrt mananade stmdure located within two htmdred fed. of the Affected Land, exceElt where there is an <br />agreement between the Operator and the persons having an ~rterest in the s7uchrre that damage to the stmdure is <br />to be comparsated for by the Pemiittee; and; <br />
