NOW, THEREFORE , IT IS HEREBY ORDERED, ADJUDGED AND DECREED as
follows:
14 . The foregoing Findings of Fact and Conclusions of Law are
incorporated herein.
15 . Subject to the terms and conditions contained herein,
Applicant ' s Plan for Augmentation permits the utilization of the
described 75 acre parcel for a gravel mining operation (dry-process ,
open-pit procedure ) over a period extending approximately 20 to 25
years without injury to any other water user.
16. The use of the water rights as described in this Plan for
Augmentation does not constitute an abandonment of those rights .
17 . The Court retains jurisdiction for a period of one year from
a
the date of execution of this Decree, subject to extension for
consideration, upon motion of any party and appropriate notice to all
other parties , of whether the provisions of this Decree are
sufficient to prevent injury to the presently vested water rights or
decreed conditional water rights of the Objector. C. R. S. 1973 ,
§37-92-304 , as amended .
