Orell: <br />The follov.~ing letter is in response to your correspondence of December 6, 1977 and will <br />ccristitute the supplement to our application filed with the Board on behalf of <br />Summit Pressed Brick and Tile Co. In order to be responsive to your concerns, I <br />will address those items in your letter or. an item by item basis: <br />Item 1: Exhibit A-Concern is expressed over the legal description of the lease <br />versus the 9.9 acre permit request. Intrcdur_tion to the legal description, therefore, <br />now reads as follows: "This application covers g.g acres within the following <br />legal subdivision and acreage", on the enclosed revision of Exhibit A. Also <br />enclosed is the revised C-3 Mine Plan htap o-rhich clearly delineates the 9.9 acres to <br />be permitted. <br />Item 2: Exhibit C-2 Enclosed is a revision of this exhibit with the legend changed <br />from "permit application area" to "lease area". <br />Item 3: Exhibit B-The acreage mined has been reestimated and corrected to 0.12 acres/ <br />year. <br />Item 4: Exhibit B-Add the following: "Topsoil stockout locations shall be contained <br />within the affected permit area." <br />Item 5: Exhibit E--Assuming a typographical error in your letter I presume that the <br />"or•" should read "to"? If that assumption is correct the issue should be clarified <br />by changing the verbage from "average depths" to "approximate aepths.•~ <br />Item 6: Exhibit E-Paragraph 2 shall be revised as follows: <br />"Based on field surveys of undisturbed portions of the lease area adjacent to <br />the mine, it is anticipated that a seeding mixture of 40% Blue Grama, 20% t.egume <br />Species, and 40% Wheatgrass species o-rill he used. Other native grass species <br />present on the site are not commercially available as seed. seeding mixtures <br />
