The Ditch Company <br />objected to Lafarge West, Inc.'s application for the Duckworth Pit Mining and Reclamation Plan <br />(M-2003-091) because Lafarge intended to relocate the Smith and Emmons Ditch to facilitate <br />mining of the Duckworth Pit. To relocate the Ditch, the Ditch Company required Lafarge to <br />execute a written agreement dictating the benefits and obligations of the parties. <br />On September 13, 2004, the Ditch Company and Lafarge executed the written agreement, which <br />Lafarge has already forwazded to you. As a result, the Ditch Company no longer objects to <br />Lafarge's mining of the Duckworth Pit and, hereby, withdraws its objection.
