<br />Minutes, October 17 - 18, 1990 11 <br />issues remain unresolved, therefore, the Division would not recommend <br />that the Board reconsider its July 25, 1990 Order at this time. <br />tdr. Jim Hendricks, mine manager, addressed the Board briefly, regarding <br />the acquisition of the land prior to submitting a bond to the Division. <br />It was MOVED that the Board not reconsider this issue and direct the <br />Divisio`n"1'o contin"e to be supportive of the effort to join with the <br />operator in possibly renewing the permit, subject to the operator's <br />response to adequacy concerns and re-submittal of the necessary bond <br />and that the Division's support should continue for up to one year <br />after the Board's July 25, 1990, decision or to July of 1991. Consider reclamation bond forfeiture. <br />This matter was presented at the September Board Meeting for forfeiture <br />of the reclamation bond. Because the operator thought he had lost <br />right of entry to the property, the Division proposed that the Board <br />allow time for the Division and the operator to talk with the two <br />landowners involved in an attempt to regain access to the property to <br />conduct reclamation. Staff discussed this issue with the landowners <br />and explained the need for reclamation to be completed at the site. <br />The landowners are willing to continue discussion of this issue. <br />Staff recommended that the Board continue this matter to the November <br />Board Meeting, in order for the Division to discuss this issue further <br />with the landowners to work out a manner in which reclamation could be <br />completed. <br />It was MOVED that the Board continue this matter to the November Board <br />Meeting-SECONDED AND PASSED UNANIMOUSLY (Cooley, Kraeger-Rovey, <br />Danielson and Donald). <br />Staff Presentation by Randall P.
