During our phone conversation on December 27, 1995, you said your main
concern is that alert-foot deep pit will adjoin your property when mining is finished. As
I explained, this is a local land use issue that does not come under the jurisdiction of this
agency.
When you say you are concerned do you mean you object to this mining operation? If
you do object to the project please submit specific reasons for the objection and, also,
submit documentation to substantiate your claim. After receiving your objection, the
Division will schedule an informal conference pursuant to the requirements of Rules 1.7
and 1.4.6. In addition, the Division will set the application for a hearing before the
Mined Land Reclamation Board.
If you are not objecting to the permit application please notify the Division by
January 18, 1996.
If you have any questions at all give me a call.
Sincerely,
~~
James Dlllle
Environmental Protection Specialist
cc: Art Stoekebrand, Southway Construction Co., Inc M:~OSSamm~5levens.ld
