The <br />Division oFMinerals and Geology (Division) is required to make an approval or denial decision no <br />later than t)ctober 27, 1998, therefore, your response to the following adequacy review concerns <br />should be :submitted to the Division as soon as possible. If you feel more time is needed to complete <br />your reply. an extension to the decision date can be granted by the Division. This will be done upon <br />receipt of IL written waiver of your right to a decision by October 27, 1998 and request for additional <br />time. This must be received no later than the deadline date. <br />As noted during the pre-operation inspection, the public notice contained an incorrect comment <br />per iod end date. Please send the Division a corrected version of the public notice. The <br />Di•~ision received two commenUobjection letters during the public comment period. The <br />levers aze attached for your reference. An informal conference will be scheduled in the near <br />future to obtain any additional comments and identify and resolve issues if possible. <br />2. As required by Rule 1.6.2(1)(e), please provide proof of notices to all easement holders that are <br />wil:hin 200 feet of the boundary of the affected land. This would include easement holders for <br />the gas pipeline and any utility line within 200 feet of the permit boundary. A copy of the <br />signed, certified mail return receipt card is acceptable. Please note that a 41 day comment <br />period will be required if easement holders have not been previously notified. <br />Rule 6.2.1(2)(b) requires that maps and exhibits be prepared and signed by a registered land <br />surveyor, professional engineer, or other qualified person. Please have the maps and exhibits <br />signed in accordance with the Rule. It would also be helpful to have larger maps in order to <br />int=rpret the contour lines, and the features located on the mining and reclamation plans. <br />4. Exhibits A, B and N reference three different legal descriptions of the proposed gravel pit. The <br />lei al description in E.~cltibit A states that the Tellier Gravel Pit is located in the NEl/4 of the <br />Nf:l/4 of Section l7. The project location map depicts the pit in the NEl/4 of the NW l/4 of <br />
