LOCATION:
Location of the mine property is described in several cases, differently. The lease with Mr Porco
indicates S'/z of the SW '/<; descripfion of page 2 of the permit indicates SW Yo of SW Ye; the general
location map indicates SE '/< of the SE'/<; and the lazger scale location map indicates SW '/a of the SE '/<
more or less, and the county conditional use resolution indicates SE '/< of the SW '/<, all in section 18,
T35N, R8E, NMPM. Please state unequivocally where the site will be located, and submit revised site
rnaps showing a mine pit boundary that is consistent with the azea described in your lease with Mr Porco
and within the azea demarcated by the County Conditional Use Resolution. It appears that the County
Conditional Use Resolution is definitive, and that the pit is to be within the SW '/< of the SW '/<. Also,
pemmt azea boundaries must be posted in the field.
EXHIBIT B: Adequate
EXHIIBT C:
Please indicate unequivocally whether fuel, oil, lubricants, or anti-freeze will be stored on the mine site.
If so, please provide plans for containing spills from such stored liquids.
Please indicate how blasting will be conducted. If blasting materials aze to be stored on site, please
indicate how and where they will be stored and protected. It is my understanding currently that you plan
to contract for all blasting; if this is the case, then please so indicate.
EXHIBIT D:
Apparently the actual azea of disturbance will be significantly lazger than the azea of excavation. Please
describe and illustrate better. The reclamation cost estimate should cover the cost for a commercial
operator, under contract, to regrade slopes to their final configuration, apply topsoil, and seed and fertilize
if necessary. The cost estimate in this section should cover the cost of reclamation, not the cost of
ruining.
EXHIBIT E:
(a) Please correct maps to show the total azea of disturbance.
(b) Show the locations of stockpiles and overburden storage.
(c) Indicate the maximum mining slopes and reclamation slopes.
(d) For pastureland, the slopes must be less than 3:1, or 3 horizontal to 1 vertical.
(e) The current reclamation cross section indicates that the pit will be left with mounds of waste rock.
This is not acceptable if the post-mining land use is to be pastureland. These mounds must be
either graded, topsoiled and seeded, or the post-mining land use must be changed to indicate waste
rock for landowners' use.
EXHIBITS F, G, H, I, J and L:
Iixhibits azea adequate.
ADDENDUM 1 -Notice Requirements -Affidavit of Posting Notice.
Now that the application has been deemed adequate, you will need to re-publish your Public Notice in a
newspaper of broad local circulation, and within 10 days of the date the application was filed. In other
words, you must publish notice before July 26.
