19. The mining plan describes the full mining of gravel pit A, except for the processing area, before moving onto <br />gravel pit C. If there is only a pond between the processing area and pit C, how will access between these two areas <br />be accomplished? There is no description of when dewatering will occur and no information about a road along the <br />unmined margin of the site. Please clarify. <br />The depth to groundwater is stated in your letter to be estimated aL 20 to 24 inches deep (your response to my <br />question #37). Numerous references are made to initial excavations often feet deep, with that whole depth sloped <br />at 3:1. Please clarify that you intend to slope the two feet above water and the ten feet below (a total of 12 feet <br />deep) at the required 3:1 gradient. <br />21. We understand that only one pit will be mined at a time, though washing and processing will occur in parts of <br />two separate areas until the very end of the life of the mine. Since the pit sizes will vary, within and between pits, <br />the bond amount must vary also. I will use the acreages you included in your responses to begin my bond estimate. <br />22. Topsoil will be stripped from its native location prior to mining. Some of the topsoil must be saved for final <br />reclamation of the pond perimeters, and therefore must be protected. Please describe how topsoil will be protected <br />during stockpiling, against damage from water erosion, wind erosion, and weed infestation. Also state whether <br />topsoil is to be stored in the setback area immediately along the creek. <br />Please be reminded that until the interiors of the pits are below groundwater level (meaning the pits have become <br />ponds) there must be sufficient topsoil retained onsite for covering more than just the perimeter slopes. <br />Exhibit E -Reclamation Plan (Rule 6.4.5) <br />25. There is still information which has not been provided about the revegetation plan. Please name the variety of <br />each grass species to be used, and the seeding rates for each of the seed species in the mix. Seeding rates must be <br />given in the form of "pounds of pure live seed per acre." <br />Please state the application rate and method for the mulch to be used, and the formulation and application rate for <br />the fertilizer to be used. <br />Please state definitively that an adequate noxious weed control plan for the site will be maintained. If you know <br />what the plan consists of, please briefly state the details. <br />Exhibit F -Reclamation Map (Rule 6 4.6) <br />31. Slopes azound the ponds, assuming a pond surface elevation about two feet below the surrounding grade, will <br />be about five or six feet long (with a 3:1 slope gradient). The reclamation map (your "Exhibit F") does not show <br />where the grade break is between level and sloping land, and actually shows a slope length inside the excavation <br />area line to range from 30 to 80 feet. Please include topographic information on the map. If in doubt about this <br />requirement, please refer to Rule 6.2.1 and Rule 6.4.6. <br />Exhibit S -Permanent Manmade Structures (Rule 6 4 19) <br />47. One of the new maps shows the alignment of the Excel Energy gas pipeline, which is within 200 feet of the <br />planned disturbance. Please provide a damage agreement as described in this rule. <br />Other Items <br />As requested in the previous letter, a receipt showing proof of filing additional materials with the clerk and recorder <br />must be provided. Your last letter, attachments and packet of maps constitute additional materials, and should have <br />been placed for review at the county. You should have obtained a receipt for that filing and sent it to me. <br />Likewise, your response to this letter will constitute more additional materials, which also must be filed there. <br />Please provide a receipt from the clerk and recorder for the last filing and for the upcoming filing, with your next <br />response. <br />
