Dept. of F!'~.'.yal Resource:;
Re: Rich Pit
Southwest Ready-Mix
Dear Sir:
We have just received your comments made to the Mined
Land Reclamation Board concerning our application for a pit
permit in which you state that you cannot recommend approval
and that you will order us to cease operations if we are pump-
ing without well permits or diverting water illegally. From
the tone of your letter I'm sure that you are not aware of the
fact that we first applied for a well permit for the pit area
on November 18, 1985, and resubmitted it for the third time
on January 6, 1986. We have not heard from your office in
answer to that application nor any of the rest of our letters
or applications since that date. It is a little disconcerting
to find out that your office is evidently predisposed against
our operation in correspondence to anotner Slate ~•,ye~~,cy, wi~tF.c::t
even bothering to answer our correspondence. Your office has not
offered to assist us in any manner during this process nor had
the courtesy to keep us informed of your decisions.
It seems ironic that we are in the process of investing
a large sum of money into a severely depressed area of the State
for a business that will create 25-50 new jobs and find that a
State Agency seems bent on insuring that the business never opens
or, if it does, intends to close it as soon as possible.
We intend to fully meet the requirements of the law con-
cerning our operations and all we ask is your assistance in help-
ing to meet those requirements. We need to know specifically
what kind of water rights you will accept to augment evaporation
loss and which way to go from here.
