The Technical <br />Revision was limited to item 5 of the applicant's 12/22/97 response to adequacy issues, <br />addressing drainage channel reconstruction and the details of the proposed drainage <br />channel indicated on the revised Exhibit F, Reclamation Map. Public comment period was <br />reopened fora 20 day period, commencing on 1 /23/98 and closing on 2/12/98, to ensure <br />opportunity for public participation in the review of the Technical Revision. DMG decision <br />date for reconsideration of its previous approval recommendation was set at 2/17/98. <br />Comments Received <br />On 2/12/98, DMG received a letter from Travis E. Stills, dated 2/12/98, objecting to the <br />application, objecting to DMG defining the applicant's 12/22/98 submittal as a Technical <br />Revision instead of an Amendment, objecting to issues within the scope of the Technical <br />Revision, objecting to issues not included within the scope of the Technical Revision, and <br />stating that the MLRB could not legally approve the application. Mr. Stills is legal council <br />for the Emerson, Bell and Morris objecting parties. <br />DMG Reconsideration of Approval Recommendation <br />DMG considered the issues raised by Mr. Stills in his 2/12/98 submittal which related <br />directly to the Technical Revision. On 2/17/98, DMG determined that its original approval <br />recommendation was issued appropriately. <br />The balance of this document is intended to explain the process by which DMG determined <br />to uphold its approval recommendation over the objections raised by Mr. Stills in his <br />2/12/98 submittal. <br />
