Long <br />Division Director <br />Listed below are additional adequacy review comments for the Deakins Pit 110 Permit Application, File No. M- <br />2001-060. The Division of Minerals and Geology ("Division") is required to make an approval or denial decision <br />no later than Ju]y 30, 2001, therefore, your response to the following adequacy review concerns should be <br />submitted to the Division as soon as possible. <br />Rule 6.3.7 Exhibit G -Source of Leeal Right-to-Enter <br />1. Exhibit G is defined as Source of legal right-to-enter. The permit application submitted for the Deakins Pit <br />contains no access agreements for the adjacent properties belonging to Robert Deakins and to the railroad <br />right of way. In that the pit on the site is located 15 feet from the boundary lines adjacent to these properties, <br />evidence that entry to these properties will not occur during the mining process or access agreements from the <br />owners are required. <br />Please be advised that the 3B Enterprises New 110 Permit Application may be deemed inadequate, and the <br />application may be denied on July 30, 2001 unless the above mentioned adequacy review items are addressed to <br />the satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can grant an <br />extension to the decision date. This will be done upon receipt of a written waiver of your right to a decision by <br />July 30, 2001 and request for additional time.
