The Division will calculate a revised reclamation cost based on the responses to the adequacy concerns <br />outlined in this letter and will include an itemized cost for mobilization demobilization of reclamation <br />equipment. <br />6.4.14 EXHIBIT S -Permanent Man-Made Structures <br />4. In response to the Division's concern for Flood impacts to the Sinclair pipeline and associated lateral <br />berm, the applicant has proposed mining the west boundary of Phase 1 at a 3: I slope and the installation <br />of an erosion control berm immediately east of the pipeline berm. The Division has several questions <br />regarding the erosion control berm design and installation. First, has Weld County reviewed and/or <br />approved the proposed plans for such Flood control structure? Second, at what point in the sequence of <br />mining when will the erosion control berm be intalled? If the applicant is willing to commit to installation <br />of [he erosion control berm prior to disturbance of the Phase 2 area, no itemized reclamation cos[ for berm <br />installation will be required. If the applicant is not able to provide such commitment, then the applicant <br />will need to include in the reclamation cost estimate an itemized cost for conswction of the erosion <br />control berm and riprap outlets. Please address. <br />Once again, I will look forward to your response on or before 1:00 P.M., February 20, 2001. Rule 1.8.1 <br />states that changes and additions to the permit application must be filed with the Division and the County <br />Clerk and Recorder.
