Shelton <br />Director, <br />Mined Land Reclamation Division <br />723 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Re: Kerr Coal Company application for permit <br />under the Colorado Surface Coal Mining <br />Reclamation Act <br />Dear Mr. Shelton: <br />Kerr Coal Company ("Kerr Coal") is a relatively <br />small, independently held Colorado corporation which is <br />currently conducting surface coal mining operations at a <br />• location approximately ten (10) miles east of Walden in <br />Jackson County, Colorado. Kerr Coal presently operates <br />an open pit coal mine known as the Marr Strip #I, to- <br />gether with an off-mine site load-out facility known <br />as the Marr Prep Plant. All of the operations of Kerr <br />Coal are covered by an Extraction and Development Permit, <br />Number 76-13 issued by the Colorado Mined Land Reclamation <br />Board ("MLRB"). This permit was recently amended to effect <br />compliance with the Interim Regulatory Program pursuant to <br />Section 502 of the Surface Mining Control and Reclamation <br />Rct ("SMCRA") and the Interim Regulations issued in connec- <br />tion therewith (30 C.F.R. Part 770.1 et seq.). <br />Accompanying this letter is an application for a <br />permit with respect to the Marr Strip #1 and the Marr Prep <br />Plant. The application is specifically directed at com- <br />pliance with the regulations for the Federal Lands Program <br />pursuant to the Permanent Regulatory Program under SMCRA <br />and serves as a request for approval of the mining plan of <br />Kerr Coal as required by 30 C.F.R. Part 211.10. The accom- <br />panying application also serves as a request for a permit or <br />permit amendment, as appropriate, from the MLRB pursuant to <br />the recently enacted Colorado Surface Coal Mining Reclamation <br />Act of 1979 (C.R.S. 1973, Section 34-33-101 et sec.).
