Dear Mr. Shelton:
Kerr Coal Company ("Kerr Coal") is a relatively
small, independently held Colorado corporation which is
currently conducting surface coal mining operations at a
• location approximately ten (10) miles east of Walden in
Jackson County, Colorado. Kerr Coal presently operates
an open pit coal mine known as the Marr Strip #I, to-
gether with an off-mine site load-out facility known
as the Marr Prep Plant. All of the operations of Kerr
Coal are covered by an Extraction and Development Permit,
Number 76-13 issued by the Colorado Mined Land Reclamation
Board ("MLRB"). This permit was recently amended to effect
compliance with the Interim Regulatory Program pursuant to
Section 502 of the Surface Mining Control and Reclamation
Rct ("SMCRA") and the Interim Regulations issued in connec-
tion therewith (30 C.F.R. Part 770.1 et seq.).
Accompanying this letter is an application for a
permit with respect to the Marr Strip #1 and the Marr Prep
Plant. The application is specifically directed at com-
pliance with the regulations for the Federal Lands Program
pursuant to the Permanent Regulatory Program under SMCRA
and serves as a request for approval of the mining plan of
Kerr Coal as required by 30 C.F.R. Part 211.10. The accom-
panying application also serves as a request for a permit or
permit amendment, as appropriate, from the MLRB pursuant to
the recently enacted Colorado Surface Coal Mining Reclamation
Act of 1979 (C.R.S. 1973, Section 34-33-101 et sec.). The net
