Reclamation Board, Department of Vatural Resources, State of Colorado.
W I T `1 E S S E T H
'„'HERE3g,?1cFarland Construction Co., Inc. desires to conduct an open minin
operation, 'utown as McFarland Pit for the purpose of extracting open
mined sand & gravel and '
WHEREAS, on February 13 1980 McFarland Construction Co., Inc. "FILED" an
anplicacion,a rec'_amacion plan and map, and the required fee, as reauired by law; and
!~'HEREdS, on March 5 1980 the Mined Land 3eclamation Board approved
McFarland Construction Co., Inc. application and set bond; and
!TEiERF~1S, on October 14 1980 the Mined Land Reclamation Board accepted
surety submitted by McFarland Construction Co.~and such date shall be considered the
date of issuance o: the ermit and the anaiversanc..
p ry ante for all ocher purposes; and
fdHERF_a5, the Mined Land Reclamation Board has made a finding, far the purposes
of issuing this permit, that:
1) the application complies with the requirements of the Colorado
Mined Land Reclamation ?.ct and all applicable local, state and
°ederal laws; and,
?) the one rat ion will not adversely affect the stability of any
significant, valuable, and permanent man-made structures located
•.oithia two hundred feet of the affected land, except where there
is an agreement beraeen the operator and the persons having an
interest in the structure that damage to the structure is to be
compensated for by the operator; and,
3) the proposed mir.irg operations and reclamation can be carried out
in conformance with the requirements of C.3.S. 1973, 34-32-116, as
amended (1976 Sass. Laws :?. °_. 1060 ; and
'vY.E3E.~S, for the purposes of issuing this Hermit, the operator has made a
satisfactory showing co the Board chat he ~aili aWploy during and after his
open mining operations procedures reasonably desiared to ainimite
as muci as practicable the disruption from the open mining operations
and will provide for the rehabilitation o? the aff;cced Land through the rahabi'_itation
of plant cover, soil stability, water resources, and other measures appropriate co the
subsepuenc beneficial use of such mined and reclaimed lands; and chat in the event
of [he failure of his proposed ceclamation plan, he will take ~rhate•~er measures which
nay be necessary in order to assure the success of reclamation of the lands affected
b;~ his open mining operations; and,
`.dHEYF_aS, for the purposes of issuing this permit, a copy of the application
approved by the :".fined Land 3eclamation 9oard of the State of Colorado is attached
to this permit and thereby becomes a part of the terns hereof.
