Box 120 <br />Alamosa, Colorado 81101 <br />RE: Bucky Clanch Pit - File no. 82-33 <br />Dear Mr. Malouff: <br />Enclosed please find a copy of a response to our Division from Conejos <br />County concerning the status of the zoning for the above captioned opera- <br />tion. It indicates that a conditional use permit is required for this <br />site to allow the extraction of gravel. Since the time for processing an <br />application for such a permit is 45 to 60 days (at least), I make the <br />following suggestions: <br />1) Contact Conejos County and make arrangements to get the conditional use <br />permit as soon as possible; <br />2) Request that our Mined Land Reclamation Board continue consideration of <br />your mining and reclamation permit application for this operation until <br />such time as a conditional use permit has been granted by Conejos County; <br />3) Request that our Mined Land Reclamation Board extend the time period <br />within which a permit for this operation should issue to avoid the nec- <br />essity for you to pay the entire $10,000.00 civil penalty for mining on <br />this site without a permit until such time as a conditional use permit can <br />be issued and our Board can consider your application. <br />I strongly urge you to complete these actions immediately. In this way, <br />you can proceed with our permitting process and avoid paying the full civil <br />penalty of $10,000.00. Please feel free to call me if I can clarify this <br />situation any further. As you are undoubtedly aware, the Board is to con- <br />sider this application during the March 24-25, 1982 meeting (next Wed.. and <br />Thurs.), and, if I do not receive requests 2) and 3) above from you before <br />that time, the Board will be forced to deny your application, and you will <br />owe the entire civil penalty. <br />I will expect to hear from you in the near future. <br />Sincerely, <br />Mark S.
