The Pemrittee, Fremont Pavurg & Redi Mix, Inc. desires to conduct a mining operation (mown <br />as McCumber Hill Pa, for the purpose of extractarg sand and gravel 'Ihe PermiLtce wi11 nd more any secondary <br />commodities. <br />B. On March 6, 2001 the Mated Land Reclamation Board (the "Board's approved the Permittee's <br />application for this permit, fixed the amount of the financial warranty and directed that this permit be issued upon <br />the filing with the Division of Minerals and Gcology (the "Division") of performance warranty and financial <br />warranty (or wartarrties) in the amount so fixed in form and substance approved by the Division. Said vvarrarrt;es <br />have bem filed with the Division. <br />C. Lf the PermiGee desires to extract materials other than those listed in (A), a separate permit may <br />be required. <br />D. On Marrh 6, 2001 the Board made the following findings: <br />1. 71re appbcation for this permit compbes with the requirematts of the Colorado Mined <br />Land Reclamation Ad forthe Extraaiw of Calstruction Materials, C.RS. 3432.5-101 ~ sue., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will nd adversely a$eect the stability of any significant, valuable, and <br />pemran®t man-made structure located within two hrmdred feet of dre Affected Land, except where there is an <br />agreenr®t belweerr the Operator and the persons having an interest in the strtrctrrre that damage to the sWChue is <br />to be compensated for by the Pennittee; and; <br />
