Wetland/Riparian Impacts -Please identify the location and extent (acreage) of any wetland resources and/or <br />woody vegetation resources such as cottonwoods or willows that occur between the proposed pit and the main <br />channel of the Colorado River. (This information may be provided on a revised Mining Plan Map). If such features <br />do exist, the Division requests that the applicant identify the surface owner(s) of each feature, quantify the extent <br />(acreage) of each feature, quantify the expected drop in water table beneath each feature as a result of de-watering <br />activities, the expected length of time of water table impact due to pit de-watering operations, specific mitigation <br />measure(s) that will be implemented to maintain the hydrologic conditions supporting each feature, and proposed <br />monitoring measures the applicant will implement to verify that anticipated hydrologic impacts have been minimized. <br />Please address. <br />Rule 6.4.19 Exhibit S -Permanent Man-made Structures <br />29. In response to the Division's initial comment regazding Exhibit S, the applicant provided Revised Exhibit C-2: <br />Mining Plan Map 200-Foot Setback Scenario to serve as the operative Mining Plan until all structure agreements or <br />engineering analyses can be obtained in order to mine closer than 200 feet from the relevant structures. However, in <br />order for the Division to make a favorable decision on this permit application, the applicant will need to commit to a <br />mine plan that follows either the Maximum Recovery Scenario or the 200-Foot Setback Scenario. If the applicant <br />chooses to commit to the Maximum Recovery Scenario, either structure agreements from Xcel Energy, Roy <br />McPherson, Antero Resources, CDOT, and the Kancillas, or, failing to reach such agreements, an engineering <br />analysis demonstrating that such structures will not be damaged by activities occurring at the mining operation will <br />need to be submitted to the Division as part of this application. Please respond. <br />Please be advised that the Grand River Park Project Reclamation Permit Application has been deemed inadequate, and the <br />application may be denied on October 6, 2006 unless the above-mentioned adequacy review items aze addressed to the <br />satisfaction of the Division. If you feel more time is needed to complete your reply, the Division can grant an extension to <br />the decision date. This will be done upon receipt of a written waiver of your right to a decision by October 6, 2006 and <br />request for additional time.
