~ ~_ ~ ! ~ BOOK 8U~PA;E 37 --~ <br />(20) All Powers and agencie~nted in this instrument are coupled with arrest and are 'vrevotable by death orb .;, .- ~ , <br />otherwise; and the rights and rcmedtes provided in thu instrument are cumulative us remedies provided by law. <br />(21) Borrower agrees that the Government will not be bound by any present or future State laws, (a) providing for <br />homestead of exemption of the property, (b) prohibiting maintenance of an acrion Cor a defcienty judgment or limiting <br />the amount thereof or the time within whichh such action must be brought, (c) prescribing any other statute of limitations, <br />(d) allowing any right of redemption, or (e) limiting the conditions which the Government may by regulation impose, in- <br />cluding the interest rate it may c uge, as a condition of approving a vansfer of [he property to a new Borrower. Borrower <br />ezpresdy waives the benefit of any such State laws <br />(22) If any put of the loan for which this instrument u given shall be uud to finance the purchax, construction <br />or repair of property to be uxd as an owneroccupied dwelling (herein called "the dwelling") and if Borrower intends to <br />ull or rent the dwelling and has obtained the Government's conxnt to do so (a) neither Borrower nor an one authorized to <br />act for Borrower will, after receipt of a bona fide offer, refuse to negotiate for the sale or rental of the dwelling or will <br />otherwix make unavailable or deny the dwelling to anyone becauu of rate, color, religion, se: or national origin, and <br />(b) Borrower recognizes as illegal and hereby disclaims, and will not comply with or attempt to enforce any restrictive cov- <br />enants on the dwelling relating to race, color, religion, sex or national origin. <br />(23) Notices given hereunder shall be sent by certified mail, unless otherwiu required by law, and addresud, unless <br />and until some other address u designated in a notice so given, in the cue of the Government to Fumers Home Adminisva- <br />tion at Denver, Colorado 80202, and in the cue oC Borrower at the address shown in the Farmers Home Admin'utration <br />Finance Offitt records (which normally will be the same as the post office address shown above). <br />(24) This instrument shall be subject to the preunt regulations of the Fumers Home Administration, and to its <br />future regulations not inconsistent with the express provisions hereof. <br />(25) Borrower has assigned or waived or will iinmedutely, on «quest of the Government, assign or waive in favor of <br />the Government all gruing privileges, permits, licenus, or Itues, appurtenant to or used N connection with the land, and <br />Borrower further covenants and agrees to procure renewals thereof prior to they exp'vation and to pay all fees and chuges <br />and to perform all acts and do all things necessuy to keep and preserve a6 said gruing tights and all renewals thereof, and N .. <br />the event of the failure of Borrower to do any of these things the Government may do so on behalf of Borrower including <br />advancing such sums u may be necessary for the purpose, and such funds advance shall be secured by this instrument. <br />(26) if any provision of this instrument or application thereof to any person or circumstances is held invalid, such <br />invalidity will not affect other provisions or applications of the instrument which can be given effect without the invalid <br />roytsion or appli~tiQn, and to that end the rovisions )tereof ue declared to be sevSrable. <br />~~~p27) BorrolJer s11 agree to sell pParcel 99FF3 pursuant to provisions of a separate agreement* <br />i ~ WITNESS the hand(s) and xal(s) of Borrower this 25th day of September 19 80 . <br />*bearing even date herewith and apply net <br />STATE OF COLORADO <br />proceeds as prow;ded for therein. <br />,lI <br />y t,tr,' ~ ~ •it.tl~~i : V (SEAL) <br />Llarry Charier <br />Patricia L.
