.' ~ ,' III III III IIIIIII III • ~ Permit No. 79-205 ' <br />999 `LIVED LAND RECLeV~IATLON BOARD <br />Department of Natural Resources <br />1313 She ratan Street, Room 423 Telephone: 839-3567 <br />Denver, Colorado 80203 <br />DEVELOPMENT t4VD EYTRACTION MINING PERMIT <br />THIS PER*fIT is issued this 15th day of August by the Mined Land <br />Reclamation Board, Department of Natural Resources, State of Colorado. <br />W I T N E S S E T H <br />WHEREAS, Mountain Mobile Mix, Inc, desires to conduct a(n) open mining <br />operation, known as Chambers Pit , Eor the purpose of extracting open <br />mined sand & gravel and <br />WHEREAS, on November 28, 1979, Mountain Mobile Mix, Inc. "FILED" an <br />application,a reclamation plan and map, and the required fee, as required by law; and <br />L,fHEREAS, on May 29 1980 the Mined Land <br />Mountain Mobile Mix, Inc, application and seC <br />WHEREAS, on August 15 1980 the Mined Land <br />surety submitted by Mountain Mobile Mix, Inc, and <br />date of issuance of the permit and the anniversary data <br />I.iEiEREAS, the Mined Land Reclamation Board has made <br />of issuing this permit, that: <br />Reclamation Board approved <br />bond; and <br />Reclamation Board accepted <br />such date shall be considered the <br />for all other purposes; and <br />a finding, for the purposes <br />1) the application complies with the requirements of the Colorado <br />`fined Land Reclamation Act and all applicable local, state and <br />Federal laws; and, <br />2) the operation will not adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />caithin two hundred feet of the affected land, except where there <br />is an agreement between the operator and Che persons having an <br />interest in the structure that damage to tha structure is co be <br />compensated Eor by the operator; and, <br />3) the proposed mining operations and reclamation can be carried out <br />in conformance with the requirements of C.R.S. 1973, 34-32-116, as <br />amended (1976 Sess. Laws H.B. 1060 ; and <br />4lHEREAS, for the purposes of issuing this permit, the operator has made a <br />satisfactory showing to the Board that he will employ during and afCer his <br />open mining operations procedures reasonably designed to minimize <br />as much as practicable the disruption from the open mining operations <br />and will provide for the rehabilitation of the affected Land through the rehabilitation <br />of plant cover, soil stability, water resources, and other measures appropriate to the <br />subsequent beneficial use of such mined and reclaimed lands; and that in the event <br />of the failure of his proposed reclamation plan, he will take whatever measures ~:hich <br />may be necessary in order to assure the success of reclamation of the lands affected <br />by his open mining operations; and, <br />!1HERE~S, for the purposes of issuing this permit, a copy of the application <br />approved by the `fined Land Reclamation Board of the Stata of Colorado is attached <br />to this permit and thereby becomes a part of the terms hereof. <br />NOIJ, THEREFORE, pursuant to the authority set forth in the Colorado `fined <br />Land Reclamation Act, Article 32 of Title 34, C.R,S. 1973, as amended, (1976 <br />Sess. Laws H.B. 1065) the `lined Land Reclamation Board of the State of Colorado <br />hereby issues a life of the sine permit to Mountain Mobile Mix, Inc. to engage <br />in open mining for tie purpose of extracting open <br />mined sand & gravel on the following parcel of ground, to wit: <br />Parts of Lots 1 and 2 of Section 15, and W-1/2 SW-1 /9, NW-1 /9 SEl/9, NE-1 /4 SE-1 /4, <br />the last mentioned subdivision being also designated as Lot One (1); Lots Two (2) <br />and Three (3) in Section Eleven and Lot One (1) in Section Fourteen; Township <br />6 South, Range 93 West of the 6th P.M., Garfield County, Colorado. <br />
