Basis of our opposition is that: <br /> 1. ) the applic4tion is defective and incorrectly recites <br /> statements of fact required for the Board' s consideration; <br /> 2. ) it is incomplete as a matter of law; <br /> 3. ) the granting of the permit would be in violation of <br /> State law; and <br /> 4. ) granting of the permit would result in a irreparable <br /> injury to the land contiguous to the mining site, which land <br /> is owned by my client, the Eagle River 1978 Trust. <br /> Please be further advised that I request an opportunity to appear <br /> before the Board of Mined Land Reclamation to make known, more <br /> particularly, my clients ' objection to the above-referenced permit. <br /> Very truly yours, <br /> a ,> � <br /> ROBERT J.
