The Permittce, Mullett's Excavating, L.L.C. desires to conduct a marring operation lmown as <br />Mulletts Expvting Pit # 1, for the purpose of extracting sand and gravel. The Permatee will nd mine any <br />seconday commodities. <br />B. On November 7, 2000 the Mined Land Reclamation Hoard (the "Board") approved the <br />Permittee's application for this permit, fixed the amount ofthe financial waranty and directed that this perm be <br />issued upon the filing with the Division of Minerals and Geology (the "Divisier") of performance warranty and <br />financial warranty (or wararrties) in the anwutrt so fixed in form and substance approved by the Division. Said <br />wararrties have beat 51ed with the Division. <br />C. lfthe Pemtittee desires to extract materials other than those listed ut (A), a separate permit may <br />be required. <br />D. On November 7, 2000 the Board made the following findings: <br />1. The application for this permit complies with the requirentatts of the Colorado Mined <br />Land Reclamation Ad for the Extraction of Construction Materials, C.R.S. 34-32.5-101 et sue., as amended, and <br />with all applicable local, state and federal laws; <br />2. The operation will not adversely affect the stability of any significarrt, valuable, and <br />pemtanent man-made strudtrre located within two htmdred fed of the Affected Land, except where there is an <br />agreemert between the Operator and the persons having an urterest m the structure that damage to the structure is <br />to be compensated for by the Permittce; and; <br />
