.,
Colorado Mined Land Reclamation Division
July 30, 1993
Page 2
It is my client's position that prior to any permit being issued to the City of Cripple
Creek for the purposes of mining operations a published environmental impact statement which
addresses the impact of runoff water pollutants from the mining operations and their effects on
the adjacent wetlands should be completed and submitted for approval to the Environmental
Protection Agency by the City of Cripple Creek. The City of Cripple Creek is required to
provide an objective good faith statement not only to determine what adverse effects may result
but also to be in compliance with the National Environmental Policy Act.
It is my client's understanding that there are several other equally suitable mining sites
available to the City of Cripple Creek. It would seem more appropriate for the City of Cripple
Creek to use pre-existing mining sites or other locations that would not have an untoward
environmental impact or diminish the surrounding property values. Finally, you should consider
the visual blemish the proposed mine location would have to the throngs of in-state and out-of-
state visitors traveling to Cripple Creek on Highway 67 which is located within sight of the
proposed mining area.
We appreciate your consideration of the issues raised in this letter and await your
responses and comments.
RGA/cb
