RE: Pre-Hearing Conference and Board Hearing, Timnath Connell Pit Application, File No.
M-99-050
Dear Mr. Swift:
In response to our recent telephone conversation I am providing you with the following information:
I) The Division has scheduled aPre-hearing Conference for the Timnath-Connell Application for
September 14, 1999 at 9 a.m. This Conference will be held in Room 215, 1313 Sherman
Street, Denver, Colorado.
Please NOTE: Each party present at this hearing must bring a list of their witnesses and exhibits -See
Rule 2.7.1(2)(e) of the Construction Materials Rules and Regulations.
In addition, at the Pre-hearing Conference, the Pre-hearing Conference Officer shall cause to be
proposed a draft Board order. The draft Board order shall provide the following:
(a) a list of the parties name, addresses and phone numbers;
(b) a list of issues to be discussed at the Board hearing;
(c) an outline of the agenda for the Board hearing and allowed times for presentations,
cross-examination by parties and closing statements;
(d) a list of each party's witnesses;
(e) a list of each party's exhibits or documents to be used as evidence.
The draft Board order shall be delivered to all parties to the hearing at least three (3) days prior to the
Board hearing, as provided in Subsection 2.2.1.
2. Following the Pre-hearing Conference there will be a Formal Board hearing to consider the
Timnath-Connell application. The Board will begin its scheduled meeting at 9 a.m. on
September 22 and 23, 1999. The meetings will be held in Room 318, 1313 Sherman Street
Denver, Colorado.
