The issuance of this permit does not ensure that <br />no injury will occur to another vested water right or preclude another owner of a vested water fight from seeking relief in a Civil court action. <br />2) The construction of this well shall be in compliance with the Water Web Construction Rules 2 CCR40&2, unless approval of a variance has <br />keen granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18. <br />3) Approved pursuant to CRS 37-90-137 (2) and (11) for the construction and operation of a well (gravel pit ground water pond) in accordance <br />with the tempprary substltute water supply plan approved by the State Engineer on December 10, 2004 and amended on December 17, 20D4, <br />for the File Pit II, Division and Minerals and Geology Permit No. M-2004-047. The well (pond) shall not be operated unless it Is Inclutled in a <br />substitute water supply plan approved by the State Engineer or a plan for augmentation approved by the Water Court. The water supply plan <br />for this pit is currently valid through December 31, 2005 and if it is no[ extended or if a court decree is not entered for a plan for <br />augmentation, this well permit is nub and void and diversion of ground wa <br />4) This well is subject to administra8on by the Division Engineer in accordance with applicable Decrees, statutes, rules, and regulations. <br />v) The total surface area ur the gravel pit yruund water yunJ is limited lu 1.5 aces (in 8ie dewatedng trenches antl a sediment pontl) exposed <br />attar January 1, 1981. No other use of water is allowed unless a <br />pemtA therefor is approved. <br />7) The owner shall mark the well In a conspicuous place with well permit number(s) and court case number(s) as appropriate. The owner shall <br />fake necessary means and precautions tp preserve these markings. <br />8) Pursuant to Policy 2000 (as amended October 1, 2002) of the State Board of Examiners of Water Weft ConsW than aril Pump Installation <br />Contractors (Board), the minimum consWCtion standards in Rule 10 of the Water Well Construction Rules shall be waived for gravel pit ground <br />water ponds except compliance with Rule 10.1 and its subsections 10.1.2, 10.1.4, 10.1.6 and Rule 10.2 and its subsection 10.2.1 is required. <br />The owner of the gravel pit shall lake necessary means and precau8ons to prevent contaminants from entedng the gravel pit groundwater <br />pond. <br />9) Pursuant to Policy 2000-4 (as amentletl October 1, 2002) of the Board, the disinfection standards oT Rule 15 of the Water Well Construction <br />Rules shall be waived and the water well construction report requirement of Rule 17 shall he waived, except compliance with Rules 17.1.4, <br />17.3 and 17.4 is required. <br />10) The boundades of the gravel pi[ ground water pond shall he more than 600 feet from any existing well constructed In the same source, that is <br />not owned by the applicant, except far the well for which a 600-foot spacing waiver statement was obtained on June 17, 1999. <br />11) Pursuant to Policy 2D00-4 (as amended Oc[ober 1, 2002) of the Board, no pumping equipment shall be installetl In the gravel pit grountl <br />water pond to withdraw water for any beneficial use, unless a separate wdtten request for a variance has been approved by the Board.
